Platform Liability of E-Commerce Platforms in the Sale of Pre-Made Dishes

预制菜产业的发展是工业化不断发展和社会职业化水平不断提高的必然结果,近年来中国预制菜产业发展迅猛,全产业链不断完善,以法治规范预制菜产业的发展已成为一项社会共识。不同于其他商品,预制菜在电商平台的销售环节中备受消费者关注,而平台责任机制因其调整经营者、平台及消费者三者权利义务关系的功能,天然成为了规范预制菜产业健康发展的最佳制度选择。通过对329份调查问卷进行定量分析,能够更加准确地探究中国预制菜产业需求侧的声音,从而助力电商平台在预制菜销售端的平台责任机制的构建。在此基础上,面对数字经济的诸多新的挑战,平台责任机制的构建必须在继承传统平台责任理论的基础上适应时代的发展,通过多元协同的方式推动中国预制菜产业实现高质量法治路径的建设,进而推动中国预制菜产业健康发展。The development of industry of pre-made dishes is an inevitable outcome of advancing industrialization and the rising professionalization of society. In recent years, Chinese pre-made dishes industry has experienced rapid growth, with continuous improvements across the entire industrial chain. Establishing legal frameworks to regulate this sector has become a societal consensus. Unlike other commodities, pre-madd dishes sold via e-commerce platforms attract significant consumer scrutiny. Platform liability mechanisms, which govern the rights and obligations among merchants, platforms, and consumers, naturally serve as the optimal institutional choice to ensure the healthy development of the industry. Through quantitative analysis of 329 survey questionnaires, we can more accurately explore demand-side perspectives within China’s pre-prepared dish industry, thereby aiding the construction of platform liability mechanisms for e-commerce platforms in pre-prepared food sales.
